Legal Separation allows spouses to become independent of each other without ending their legal marriage. Couples may choose this option over a divorce for various reasons, such as retaining health insurance, filing taxes, and religious beliefs. 

While divorce restores each individual’s legal status to single, legal separation retains the spouses’ marital status while rendering each party legally independent of the other. This independence necessitates reaching agreements in multiple areas: the division of debt and assets, childcare and custody, insurance coverage, and more. One party may opt for divorce during the legal separation process; this is allowed by the courts.
